Clients must put the order number (or invoice number) as the reference number when performing the Online Bank Transfer. It is clients’ responsibility when the orders processing or jobs are delayed due to clients not putting the order number as the online transfer reference and Everest Interior Pty Ltd cannot verify or confirm the payment in its bank account.
Clients are required to send a photo of both the payment credit/debit card and driver’s license to Everest Interior Pty Ltd via mobile phone message or email, when clients choose to use Card Payment via Phone call. Everest Interior Pty Ltd will follow the Privacy Policy to keep client’s information safe.
Everest Interior Pty Ltd has the right to carry out security checks on all orders, the security check process involves splitting the payment into two amounts. The cardholder is then required to confirm the two amounts they were charged for the order to complete its verification and be released. Everest Interior will monitor orders daily and verify purchases should they not require the verification process for example but not limited to business addresses.
Subject to you complying with these Terms and acceptance of your Order by Everest Interior Pty Ltd, Everest Interior Pty Ltd will sell and supply the products to you as shown on your Order confirmation.
Products may not be available for immediate delivery. Everest Interior handling time is 1-5 working days. If there are any further delays, Everest Interior will notify clients by emails within 2-3 business days.
When you complete your Order, you will be prompted to select whether you wish to collect your Order from a Everest Interior Pty Ltd’s warehouse/shop or to have the Order delivered to an address specified by you.
During "Free Shipping Australia Wide" promotions, terms and conditions may apply for free shipping to regional areas in Australia. Freight charges may be incurred for orders shipped outside of Metro areas.
The terms of this clause apply where you select to have your goods delivered to a specified address.
The delivery address must be an address within Australia and cannot be a freight forwarding location. Deliveries cannot be made to PO Boxes.
Everest Interior Pty Ltd will use its best endeavors to deliver your Order within any stated timeframes for dispatch, however Everest Interior Pty Ltd does not warrant that these timeframes will always be met, as many factors may affect these timeframes.
Everest Interior Pty Ltd does not include insurance as part of any product purchased; this will need to be purchased separately to protect our customers from any lost or damaged goods. Everest Interior Pty Ltd does not accept liability for any goods lost or damaged in transit without insurance. Everest Interior Pty Ltd Online cannot and will not accept responsibility for delivery failures or delays by our third party delivery contractor.

If you select to collect your goods from an Everest Interior Pty Ltd warehouse, a representative will contact you by telephone or email to notify you when the Order is available for collection.
Orders for collection at an Everest Interior Pty Ltd warehouse must be collected within 7 days of the relevant Everest Interior Pty Ltd warehouse giving you notice by telephone or by email that your Order is available for collection. If your Order is not collected within this time, the warehouse has the right to allocate those goods to another customer and reorder the goods for you.
When picking up your items, you are required to supply a copy of your order, photo ID and credit card used to make the purchase. (If you pay via PayPal, your credit card is not required).
Title and risk in the products, such as loss and damage, pass to you on delivery or collection, as the case may be.
The website employs PayPal secure payment gateway to secure our payment systems.
To the extent permitted by law, Everest Interior Pty Ltd will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by a user where a credit card or PayPal account is fraudulently used or is used in an unauthorized manner.

If any product ordered by you arrives damaged or is not of acceptable quality, you may have: - (a) rights under the Refund Policy; - (b) Legal rights and remedies in Australia under the Competition and Consumer Act 2010 and other rights under other consumer laws applying in each Australian State and Territory; and/or - (c) To have the product repaired or replaced or to receive a refund of the price paid by you for the product.

We also recommend you immediately inspect any goods that we deliver to you or that you collect from an Everest Interior warehouse, to ensure you are completely satisfied with the goods, including that the goods are of acceptable quality, and match the description we have provided to you.
Signing the delivery note means you have received the goods and they are in good working order and take ownership for those goods. Everest Interior will not be liable for these delivered goods once the delivery note is signed.
Exchanges are accepted given they are processed within 14 days from time of delivery

If you consider that the product supplied by EVEREST INTERIOR PTY LTD is defective, you can lodge a claim under this Warranty and any apparent fault, except for calibration, can be assessed by EVEREST INTERIOR PTY LTD within the Warranty Period covered for the product purchased by you provided that you meet the following conditions:
The product is of merchantable quality and was used in a good working environment
You must produce the original invoice or other proof of purchase document disclosing the purchase date.
All costs of return postage, transport and freight, traveling expenses, hiring tools and insurance are paid by the customer.
EVEREST INTERIOR PTY LTD provides this Warranty in addition to all other rights and remedies that you may have under law in relation to the products to which this Warranty relates.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a defective product and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality.
To the extent permitted by law, all other warranties whether implied or otherwise, not set out in these conditions of Warranty are excluded and EVEREST INTERIOR PTY LTD is not liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate the customer for:
Any increased cost or expenses
Any loss of profit, revenue, business, contracts or anticipated savings
Any loss or expense resulting from a claim by a third party; or
Any special, indirect or consequential loss or damage of any nature whatsoever

These terms will be governed by and interpreted in accordance with the laws of New South Wales, Australia and you irrevocably submit to the non exclusive jurisdiction of the Courts of New South Wales, Australia. If any provision of these terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of this agreement, which will continue in full force and effect.
If you access the website in a jurisdiction other than New South Wales, Australia, you are responsible for compliance with the laws of that jurisdiction, to the extent that they apply. Everest Interior Pty Ltd Online makes no representations that the content of the website complies with the laws of any country outside Australia.
If any part of these terms are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these terms and the remaining terms and provisions of these terms will remain in force and constitute the agreement between you and Everest Interior Pty Ltd.
If Everest Interior Pty Ltd merges, sells or otherwise change control of its business or this website to a third-party, Everest Interior Pty Ltd reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that Everest Interior Pty Ltd has collected from you and any agreements it has made with you.
The failure by Everest Interior Pty Ltd to exercise or enforce any right or provision under these terms will not constitute a waiver of such right or provision. Any waiver of any provision under these terms will only be effective if it is in writing and signed by Everest Interior Pty Ltd.
The lay-by period for any purchase from Everest Interior is 3 months from the date of the initial deposit.
An initial deposit of at least 20% of the total purchase price is required. The lay-by deposit will vary, depending on the purchase value. Everest Interior Pty Ltd has the right to determine the lay-by deposit.
The customer or Everest Interior has the right to cancel a lay-by.
If a customer cancels the lay-by, a termination charge of 20% of the total purchase price applies and is deducted from the refunded amount.
If Everest Interior cancels the lay-by, the customer will be given seven (7) days notice and will be entitled to a full refund of payments made.
The termination charge is a reasonable amount which is applied to compensate Everest Interior for any selling, storage, administration and restocking costs.
Any items placed on lay-by cannot be altered until the lay-by has been paid in full except with the express permission of Everest Interior management.
No items can be taken by the customer until the entire lay-by has been paid in full.
There are no returns or exchanges on lay-by items with the exception of faulty goods or in accordance with your legislated rights.
A lay-by agreement lets you buy a product and pay for it in two or more installments before taking it home.
The Everest Interior Customer Friendly Refund Policy:
Within 21 days of purchase;
Unused with the original packaging, manual and accessories must be included. Items must be returned in original resalable condition.
A proof of purchase must be valid, or a return request will be denied.
If your item(s) is a ' Special Order' item a refund or exchange will not be accepted. This is when the item has been specifically ordered for you and is not part of Everest Interior core range.
Clients cannot refund the product if the product is on special and due to it being a discontinued range.
Please verify that your goods have been shipped correctly without damage when receiving stock. No signed goods returned will be accepted as damaged in transit if signed for by with the shipping company.
If any product ordered by you arrives damaged or is not of acceptable quality you may have:
rights under the Refund Policy;
Legal rights and remedies in Australia under the Competition and Consumer Act 2010 and other rights under other consumer laws applying in each Australian State and Territory; and/or
To have the product repaired or replaced or to receive a refund of the price paid by you for the product.
We recommend you immediately inspect any goods that we deliver to you or that you collect from the Everest Interior warehouse, to ensure you are completely satisfied with the goods, including that the goods are of acceptable quality, and match the description we have provided to you.
Signing the delivery note means you have received the goods and they are in good working order and take ownership for those goods. Everest Interior will not be liable for these delivered goods once the delivery note is signed.

If the problem is not major we will replace the item within a reasonable time, if the replacement is not completed within a reasonable time you can choose a refund.
If you consider that the product supplied by EVEREST INTERIOR PTY LTD is defective, you can lodge a claim under this Warranty and any apparent fault, except for calibration, can be assessed by EVEREST INTERIOR PTY LTD within the Warranty Period covered for the product purchased by you provided that you meet the following conditions;
The product is of merchantable quality and was used in a good working environment
You must produce the original invoice or other proof of purchase document disclosing the purchase date.

To the extent permitted by law, all other warranties whether implied or otherwise, not set out in these conditions of Warranty are excluded and EVEREST INTERIOR PTY LTD is not liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate the customer for:
Any increased cost or expenses
Any loss of profit, revenue, business, contracts or anticipated savings
Any loss or expense resulting from a claim by a third party; or
Any special, indirect or consequential loss or damage of any nature whatsoever
Unless otherwise agreed in writing, EVEREST INTERIOR PTY LTD has no liability for, and is not required to provide Warranty Services under this Warranty if it relates to:

Warranty services outside of Business Hours,
Misusing or abusing the product or any of the accessories included within the kit,
Operating the product in a manner that is not in accordance with the Instruction Manual supplied with the product,
Using the with knowledge of or evidence of partial failure or a fault,
Not having taken reasonable steps to prevent damage or failure from occurring to the product,
Storing the product inconsistently to the instructions provided in the Instruction Manual,
Neglecting or otherwise failing to maintain the product in accordance with the instructions in the Instruction Manual,
Repairing or carrying out work on the product by any person other than a person or organization authorized by EVEREST INTERIOR PTY LTD.
Products purchased from a private seller or another dealer other than EVEREST INTERIOR PTY LTD or Everest Interior.
Accidental damage or damage caused by Force Major Events including:
environmental factors,
natural discolouration of material due to ultraviolet light,
crushing, impact with hard surfaces or damage cause in the transit of the product or to any parts,
damage caused by excessive heat or cold ,
damaged caused by solvents, or water entry into the product (for non-waterproof product),
damaged caused by contact with sand, rust, corrosion, fire, vermin and insect infestation, power outages or surges or inadequate voltage or current,
abnormal product performance caused by any ancillary equipment interference or other external factors,
Damage, failure or defects that occur for reason or reasons that were already disclosed to you or ought reasonably to have been disclosed to you prior to your purchase of the product,
Freight cost associated with transporting the product between you and the place of purchase,
No changes to these conditions are to be made without the written approval of the supplier.
